What Inquirail is
Inquirail is an automated SaaS software subscription for synthetic contact-form monitoring. The software opens monitored form pages in a real browser, submits clearly synthetic test data, checks success signals, and can verify that expected notification emails arrive. Monitoring runs as scheduled automated checks at a frequency based on your selected plan.
Business use and authority
Inquirail is intended for business and professional use. By creating an account or starting a subscription, you confirm that you are at least 18 years old, have legal capacity to enter into these Terms, and have authority to bind the business, agency, or organization you represent.
If you are a consumer (an individual acting outside a trade, business, or profession), mandatory statutory consumer protections under your applicable law remain unaffected by these Terms. Where a provision in these Terms would conflict with a mandatory consumer right, that provision does not apply to you to the extent of the conflict.
Account security
You are responsible for keeping account credentials confidential, restricting access to authorized users, and promptly notifying us if you suspect unauthorized account access. You are responsible for activity performed through your account unless applicable law provides otherwise.
Customer responsibilities
You may use Inquirail only to test forms, websites, inboxes, and notification flows that you own or are explicitly authorized to monitor. You must not use Inquirail to monitor competitors, third-party websites, or any system without permission. Inquirail is designed for synthetic-only test data by default, and you are responsible for configuring monitored forms in a lawful and proportionate way.
Authorized use only
Unauthorized monitoring, competitor monitoring, abusive submissions, or use of the software against third-party systems without permission is strictly prohibited. You are responsible for ensuring that your use of Inquirail complies with applicable law, contractual obligations, platform rules, and internal policies.
No vulnerability scanning
Inquirail is not penetration-testing software, vulnerability scanning software, scraping software, or a security attack tool. You must not use it to probe systems for weaknesses, bypass access controls, overload systems, or submit abusive traffic.
Prohibited use
You must not use Inquirail for unlawful, abusive, deceptive, spam, harassment, denial-of-service, scraping, credential collection, vulnerability discovery, regulated, illegal, or age-restricted activity. You must not use the software to infringe intellectual property rights or to test third-party systems without permission.
Subscriptions and billing
Paid access is sold as a recurring software subscription. Payments are processed by Stripe, Inc., which acts as Merchant of Record for Inquirail subscriptions. As Merchant of Record, Stripe is responsible for payment processing, tax calculation, tax collection, and tax remittance (including VAT/GST) on your behalf. The price shown on the pricing page excludes applicable VAT/GST; the final amount including any applicable tax is displayed in Stripe Checkout before you complete your purchase. Inquirail does not store full card numbers. Plan limits, prices, billing periods, and subscription status are shown during checkout or inside the account area. Unless stated otherwise before checkout, paid plans renew monthly until cancelled.
Cancellation
You may cancel a subscription at any time using at least two methods: (1) self-service cancellation from within the account area, or (2) by emailing hello@practicalapps.studio. Unless required otherwise by law or stated in the Refund & Cancellation Policy, access continues until the end of the already-paid billing period. Cancellation prevents future automatic renewals.
Refunds
Refund and cancellation rules are described in the Refund & Cancellation Policy. Unless required by law, fees already paid for the current billing period are not automatically refunded after cancellation.
Intellectual property
Inquirail, including its software, interface, code, designs, trademarks, text, reports, and documentation, is owned by Egységmester Kft. or its licensors. These Terms do not transfer ownership of Inquirail to you. You receive a limited, revocable, non-exclusive, non-transferable right to use the software during an active subscription, subject to these Terms.
Customer content and monitored targets
You retain ownership of URLs, configuration, account data, monitoring settings, and other content you provide. You grant Inquirail the limited rights needed to process that content to operate the software, run synthetic checks, store monitoring history, display reports, and send alerts.
AS-IS software and no warranty
Inquirail is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, Egységmester Kft. disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free operation, availability, accuracy, and reliability.
No guarantee of detection
Inquirail is an automated monitoring tool. It does not guarantee that every error, outage, misconfiguration, missed lead, failed form submission, delayed notification, or malfunction will be detected or reported in time. Tests are scheduled and sample-based. False negatives and false positives may occur. Results may be affected by third-party systems and changes, including form plugins, website platforms, email providers, CRM tools, network conditions, hosting providers, spam filters, CAPTCHA, bot protection, consent tools, browser behavior, and rate limits. You remain responsible for the final verification and operation of your own lead capture process.
No guarantee of results
Inquirail monitors technical form flows and notification delivery. It does not guarantee higher conversion rates, more leads, more revenue, sales outcomes, marketing performance, business continuity, or any particular commercial result.
Limitation of liability
To the fullest extent permitted by applicable law, Egységmester Kft. and Inquirail are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including any loss of profits, revenue, anticipated savings, leads, data, goodwill, business, or business opportunities, or any business interruption or reputational harm, in each case whether or not foreseeable and whether or not advised that such damages may occur.
To the fullest extent permitted by applicable law, the total aggregate liability of Egységmester Kft. and Inquirail for all claims arising out of or relating to the software, subscription, account, monitoring results, alerts, or these Terms will not exceed the total subscription fees actually paid by you to Egységmester Kft. for Inquirail during the three months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation, for wilful or intentional misconduct, for gross negligence where it cannot be excluded, for death or personal injury caused by negligence, or any other liability that cannot be limited or excluded under mandatory Hungarian or EU law. Nothing in this section limits any liability or rights that cannot be limited or excluded under mandatory consumer-protection law where the customer is a consumer.
Indemnification
You agree to indemnify, defend, and hold harmless Egységmester Kft., Inquirail, and their officers, employees, contractors, and affiliates from and against claims, damages, liabilities, losses, costs, and expenses arising from your unauthorized monitoring of a website, form, inbox, CRM, or system that you do not own or are not authorized to test; your violation of these Terms; your unlawful use of the software; or your infringement of third-party rights.
Force majeure and third-party systems
Egységmester Kft. is not responsible for delay, failure, degraded performance, or downtime caused by events beyond reasonable control, including force majeure events, internet or network failures, hosting provider outages, payment processor issues, Stripe downtime, email provider failures, DNS problems, browser vendor changes, third-party API failures, legal restrictions, labor disputes, war, civil unrest, natural disasters, or government action.
Software changes, maintenance, and downtime
Inquirail may change, improve, suspend, limit, or discontinue features as part of normal software operation. Planned or unplanned maintenance, infrastructure changes, software updates, or security measures may cause temporary downtime or changes in monitoring behavior. Online software cannot be guaranteed to be uninterrupted or error-free.
Suspension and termination
We may suspend or terminate access if you breach these Terms, use the software unlawfully, create risk for third-party systems, fail to pay amounts due, or if continued access would create legal, security, or operational risk. You may stop using the software and cancel future renewals at any time.
Changes to these Terms
We may update these Terms to reflect software changes, legal requirements, payment processor requirements, or operational changes. The updated version will be posted on this page with a new “Last updated” date. If a change materially affects an active subscription, reasonable notice will be provided where required by applicable law.
Governing law and jurisdiction
These Terms are governed by the laws of Hungary, without regard to conflict-of-law rules. Unless mandatory law provides otherwise, disputes are subject to the jurisdiction of the competent court based on the registered seat of Egységmester Kft. in Hungary. If you are a consumer in the EU, you may also benefit from mandatory consumer protection laws of your country of residence. For EU-based consumers, the European Commission provides an online dispute resolution platform (ODR) at https://ec.europa.eu/consumers/odr. Our email for ODR purposes is hello@practicalapps.studio.
